Environmental and work safety requirements for suppliers and subcontractors

The supplier is obliged to organize and perform the work carried out in accordance with the subject of the Supply / Cooperation Agreement in such a way as to guarantee safe and hygienic working conditions and compliance with the environmental protection requirements. These requirements regarding occupational health and safety as well as environmental protection, apply to the Supplier and all persons employed by the Supplier to perform the Supply / Cooperation Agreement, who carry out work for the Supplier on the basis of employment relationships or a civil law contract.

Whenever these requirements refer to the premises of the Plant, they should be understood as all locations and territories of each organizational unit of the Recipient, i.e. Protec Sp. z o. o., regardless of the type of activity conducted there.

In the field of environmental protection, suppliers and subcontractors are obliged to:

  • Comply with all applicable laws and regulations relating to the protection of the environment and actively take steps to contribute to its protection;
  • Implement actions aimed at reducing the consumption of raw materials and resources, while minimizing the generation of pollution and waste;
  • Encourage their own suppliers and subcontractors to raise awareness of environmental responsibility, initiate their own environmental protection programs, and apply a sustainable development policy;
  • Ensure that vehicles are maintained in good technical condition and meet all emission standards;
  • Notify immediately employees of the Plant about the situation in case of threat of environmental pollution on the territory of PROTEC Sp. z o.o. (including, among others, caused by a malfunction of the vehicle), and the causes and consequences of the malfunction should be removed immediately;
  • Promote the development and implementation of technologies that reduce greenhouse gas emissions and energy consumption;
  • Ensure that all hazardous substances and mixtures used for PROTEC Sp. z o.o. and on its territory have original and legible labeling (pictograms) on the packaging;
  • Ensure that all hazardous substances and mixtures stored and used on the territory of PROTEC Sp. z o.o., were secured in such a way that they did not pose a threat to the environment and people;
  • Possess all permits related to environmental protection, required by current legislation and necessary for the proper performance of the contract;
  • Have safety data sheets for hazardous substances and mixtures used in their work and train all their subordinate staff with this knowledge;
  • Ensure an appropriate level of waste segregation and collection to enable its reuse to the maximum extent possible;
  • Remove all waste generated during work performed for PROTEC Sp. z o.o. and on its territory, in accordance with current legislation, unless otherwise provided by the provisions of the contract.

To guarantee occupational safety and health, suppliers and subcontractors are obliged to:

  • Comply with the requirements and rules of occupational safety and health, as well as the internal rules of traffic organization of the Recipient’s organizational unit.
  • Use only serviceable vehicles, machines, devices and equipment necessary to perform the works, meeting the requirements of safety rules and standards and having full set of equipment and civil liability insurance. The Supplier is obliged to provide, at the request of the Recipient, documentation that confirms the serviceability and safety of vehicles, devices, machines and networks used in connection with the implementation of the subject of the Supply / Cooperation Agreement.
  • Employ for the implementation of the subject of the Supply / Cooperation Agreement only persons who have the appropriate professional qualifications and authorizations required by law, valid medical certificates, undergone studies and training on occupational safety.
  • Wear protective footwear on the territory of the Plant (boots with toe caps), yellow or orange reflective vests and other protective clothing, which they are obliged to wear at all times outside the cabin of the vehicle on the territory of the Plant, as well as take other protective measures in accordance with the assessment of occupational risk for this activity consistent with the scope of the concluded Supply / Cooperation Agreement.
  • Remove all dirt and waste generated as a result of the performance of the Supply / Cooperation Agreement.
  • Equip vehicles and mechanisms with a fire extinguisher and a first aid kit.
  • Carry out unloading and loading works only in the specified place and at the specified time, after consultation with the Recipient’s employees.
  • Fix the cargo from moving reliably, taking into account the conditions at the Plant.
  • Immediately report to the Recipient incidents, accidents or potential accidents, as well as threats to health and life occurring on the construction site or in connection with its management.
  • Conduct an investigation in the event of an employee accident and ensure the presence of the Recipient’s representative during the investigation, as well as provide him with accident documentation.
  • Label properly the subject of the Supply / Cooperation Agreement if it poses or may pose a threat to health or life.
  • Present for the Recipient’s inspection the current decision of the Office of Technical Inspection on approval for operation and certificates of the equipment used (if required), in the case of using equipment subject to technical inspection.

It is forbidden to:

  • Leave vehicles, machines, devices and equipment with the engine running.
  • Use the phone while driving, performing operator functions or performing work.
  • Wash vehicles, machines, devices and networks on the territory of the Plant.
  • Stop and park outside the places set by the Recipient.
  •  Eliminate the consequences of accidents without the consent of the Recipient.
  • Transport people in cargo containers and in places not intended for this (including the cabin with insufficient number of seats).
  • Exceed the previously agreed speed allowed on the Plant’s territory.

Failure to comply with the requirements and rules of occupational safety and hygiene, as well as the aforementioned environmental requirements will result in the Recipient’s right to impose a financial penalty of up to PLN 1,000 for each failure and to charge the Supplier with the costs of covering any losses caused by its activities.

Suppliers and subcontractors bear full responsibility for any damage caused by their fault on the territory of PROTEC Sp. z o.o., possible damage to the environment, as well as occupational safety and health caused by their actions.
